This is a legal and binding contract entered into by Diane Quitoni, hereinafter referred to as the Breeder and, your name, hereinafter referred to as the Buyer.

On this day, the above-described dog has been sold to the following individual, with full Registration, for the sum of $

It is further agreed by both parties that:

A. Use of the dog:

The Buyer acknowledges that this puppy is being sold as a Show Prospect with Full Registration.  The Buyer agrees that this dog will not be used for breeding until he/she reaches a minimum of 2 years of age and has successfully passed his/her OFA hip and elbow, cardiac, and thyroid tests. The Buyer understands that he/she is responsible for ANY PUPPIES produced by this dog for life and will take back any puppy that can no longer be kept by owner no matter what the age of the dog, and accepts the responsibility to ensure no indiscriminate breeding takes
place, and that no puppies sired by this dog will be sold to wholesale or retail outlets or auctions.

Buyer agrees this dog will not be bred to anything that came from a puppy mill either directly or indirectly, furthermore, when choosing a mate the pedigree will be of highest importance, eliminating the less desirable pedigree's.
Buyer also agrees that a minimum of 30 Champion in any said pedigree will be the very lest number you will breed this dog to but 50 would be more desirable.
If your not knowledgeable with the Ridgeback pedigree you agree to confer with the breeder when looking for a mate.

Buyer agrees that the dog is not purchased for resale nor will it be trained for activities which are illegal or for which it is not suited by reason of temperament or conformation. Specifically it will not be used or trained for attack dog or to fight other animals. The buyer agrees that he/she will not sell, transfer or give away ownership or possession of this dog in anyway or any of his/her progeny to any person, persons or organization.



B. Health:

The Breeder guarantees said puppy to be in good health on date of sale or the
Buyer could return the puppy within 5 days of receipt of the animal. The buyer
Agrees to take the puppy to his/her veterinarian within 96 hours or 4 days of
Receipt of the puppy for evaluation in order for this guarantee to be valid. The
Breeder will provide the Buyer with a complete health record on the day of sale.
If the puppy is found to be in poor health or possessing a serious genetic defect, a
Statement in writing must be provided by the veterinarian documenting said
Condition for the Breeder’s veterinarian to review. The dog/puppy may be returned for full purchase price minus any shipping. Also, the paperwork that came with said dog/puppy AKC, Microchip paperwork, health certificate and shot record must be returned at the same time as puppy/dog. The puppy must be returned in the same condition as when it left the breeder’s home.


The Breeder further warrants that the puppy is free of any congenital defects, as far as can be determined at the time of the sale. In the event the puppy develops any such condition that proves to be life threatening within the next 2 years, upon the examination of a veterinarian of the Breeder’s choice, the Breeder’s sole responsibility will be to replace said puppy with one from the next available litter.

The puppy has been thoroughly checked for dermoid sinus and at the time of the sale, none has been detected. Should the dog be found to have a dermoid sinus anytime during its’ life, the Breeder will pay up to $300 for removal surgery. Additionally, the puppy has had a microchip implanted in the back of the neck for
Permanent identification –


It is buyer’s responsibility to prevent illness and injury by providing necessary
booster vaccinations, veterinary care, fresh water, nutrition, exercise and
supervision.

Further, the breeder warrants that both the sire and dam’s hip and elbows have
been X-rayed and evaluated by the Orthopedic Foundation for Animals (OFA)
and have a passing evaluation in accordance with the Orthopedic Foundation.



C. Guarantee:

The Breeder further warrants that the puppy is free of any congenital defects, as
Far as can be determined at the time of the sale. In the event the puppy develops

Upon the examination of a veterinarian of the Breeder’s choice, the Breeder’s
Sole responsibility will be to replace said puppy with one from the next available

D. Ownership Responsibilities:

The Buyer agrees to maintain the dog in a humane environment and properly
Train and care for it. It is NEVER to be an outside dog. Specifically the property licensed and Inoculated against rabies, distemper, parvo virus and other communicable
Diseases as recommended by a qualified veterinarian. The dog will not be allowed to roam and will be socialized and obedience trained appropriately as well as maintaining quality diet, appropriate exercise and Nu-Vet vitamin supplements –  We reccomend keeping him/her on Nu-Vet for the life of the dog however,as part of our health guarantee, this puppy must be kept on the Nu-Vet Plus vitamins for a minimum of the first 2-year’s of his/her life, failure to meet these requirements will void guarantee’s. Buyer agrees the puppy/dog will reside in the home of the buyer and is NEVER to be chained or tied up.
Buyer agrees that seller will repossessed puppy/dog upon evidence of neglect and or abuse at no expense to seller without any refund in whole or part.
Buyers will be 100% financially responsible for the care related to the puppy/dog. Buyer agrees to notify Breeder of any address change and to send regular
Up dates and pictures. Any picture sent to breeder may be
Published on breeders website. Buyer agrees to notify breeder of any health related issues especially those that may have some impact on Breeder’s breeding program.

The buyer further agrees that pets weight will be under strict supervision. It is far better to have a slightly under weight dog than and overweight,
Because excess weight contributes to structural breakdown of the dog. Buyer also
Agrees nothing will be given to the dog to encourage rapid growth:
Including steroids.
This dog is an INDOOR dog, and is never to live outdoors or be left outside in the elements for extended periods of time.


E. Rights of Recovery/Placement:

In the unlikely event the Buyer or Buyers are unable to keep the dog or provide an appropriate home in accordance with this agreement, the dog with it’s registration will not be transferred to any person, persons or organization other than the breeder, whether by sale, gift, loan or otherwise, unless agreed to by Breeder in writing. Buyer agrees to notify the Breeder if any such contingency arises and will not abandon the dog to a shelter or sell or give away the dog. If dog has been sold or given away without the Breeders knowledge and the Breeder discovers this, Breeder will take legal action and the original Buyer/Buyers for all legal expenses incurred.
The breeder wishes to ensure that this dog is always in a place where he/she will always
Be given the proper care.


Buyer agrees that he/she has read and understands the term of this contract fully. This contract is under the jurisdiction of the state of Tennessee, in the county of Fentress. It is agreed the place of venue shall be in the state of the breeder’s residence. Any breech of this contract could be detrimental to the name and reputation of the breeder/seller and the breeder/seller will be entitled to 5 times the purchase price of the puppy including but not limited to attorneys fees, court cost, any and all expenses acquired and (or) the puppy/dog back. All other states and counties are asked to please accept this contract as legally binding and enforceable.



LIMITATION OF LIABILITY.

In no event will Breeder be liable for any incidental or consequential damages including, without limitation, loss of profit and claims of 3rd parties, however caused. All questions concerning the validity, operation, interpretation and construction of this Agreement shall be governed by and determined in accordance with the laws of the State of Tennessee or in the state of the breeder residence. In the event that one or more provisions contained in this Agreement should, for any reason, be held to be unenforceable in any respect under the laws of any state or of the United States, unenforceability shall not affect any other provisions of this Agreement, but this Agreement shall be construed as if such unenforceable provisions had not been contained herein.

This contract is designed to protect the Rhodesian Ridgeback and its future offspring, the Breeder and the Buyer of said Ridgeback. By signing, all parties agree to all clauses of this contract.
